According to L’Equipe, the Toulouse Prosecutor’s Office has officially launched a preliminary criminal investigation into Toulouse’s Norwegian international Aaron Donam, accusing him of racial discrimination.

The incident originated from the Ligue 1 match between Toulouse and Le Havre in November. During stoppage time, Donham was accused of swiping his hand in front of his nose in front of Le Havre's Cameroon midfielder Simon Ebonog, implying that the opponent "stinked." The move sparked intense controversy, with Le Havre coach Didier Digal publicly expressing indignation, and public opinion generally questioning it as a racist act, although Donham himself firmly denied it.

In addition to facing a criminal investigation, Donham will also attend a hearing before the French Professional Football League's Disciplinary Committee on November 26. Toulouse prosecutor David Schalmaz stressed to L'Equipe that football governing bodies cannot be relied upon solely to deal with such behavior and that judicial intervention is necessary. After the controversy, Donnam returned to the Norwegian national team and came on as a substitute against Estonia.
